These Terms of Service (the "Terms") constitute a legally binding agreement between you ("you", "your", or "Customer") and Peptide Test Canada ("we", "us", or "our"), an Ontario-based independent analytical laboratory operating the website peptidetestcanada.ca (the "Website") and providing research peptide testing services (the "Services"). By accessing the Website, placing an order, or submitting a sample, you agree to be bound by these Terms.

RESEARCH USE ONLY — IMPORTANT NOTICE. All testing services are provided for laboratory research and analytical purposes only. Peptide Test Canada does not sell research peptides. We test customer-supplied samples solely to characterize their analytical properties. Samples and test results are not intended for human or animal consumption, diagnostic use, therapeutic use, or any in vivo application. By using our Services, you confirm that the samples you submit are intended exclusively for research purposes and that you assume all responsibility for compliance with applicable laws.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under the laws of your province or territory of residence to use the Services. The Services are intended for residents of Canada. By using the Services, you represent and warrant that you meet these requirements.

2. Description of Services

We provide third-party laboratory analysis of research peptide samples submitted by Customers. Services may include high-performance liquid chromatography (HPLC) purity analysis, mass spectrometry identity confirmation, mass accuracy testing, heavy metals screening, endotoxin (LAL) testing, microbial/pathogen screening, bacteriostatic water testing, and rush turnaround options. The exact scope of Services purchased is described in your order confirmation.

3. Sample Submission

After placing an order you will receive instructions for shipping your sample to our Mississauga, Ontario laboratory. You are responsible for:

  • Properly packaging and labelling your sample;
  • The cost and risk of shipping the sample to us;
  • Providing sufficient sample volume for analysis (minimum quantities will be communicated to you);
  • Disclosing any known hazards, contaminants, or sensitivities;
  • Ensuring you have lawful possession of the sample under all applicable Canadian federal, provincial, and municipal laws.

We reserve the right to refuse, return, or destroy any sample that, in our sole discretion, presents a safety, regulatory, or legal concern.

4. Pricing and Payment

All prices are listed in Canadian Dollars (CAD) and are exclusive of applicable taxes (GST, HST, PST/QST), which will be calculated and added at checkout in accordance with Canadian tax law. Payment is processed securely by our payment processor, Stripe Payments Canada, Ltd., and is required in full at the time of order. By submitting payment, you authorize us to charge the payment method provided for the total order amount, including taxes and any applicable shipping fees.

5. Turnaround Time

Standard turnaround is three (3) to five (5) business days from the date of sample receipt at our laboratory. Rush service, where purchased, provides one (1) business day turnaround. Turnaround estimates are not guaranteed and may be affected by sample condition, instrument availability, holidays, or other operational factors.

6. Certificate of Analysis (COA)

Upon completion of testing, we will deliver a Certificate of Analysis (COA) to the email address you provided at checkout. The COA reports analytical findings on the specific sample submitted and is valid only for that sample. The COA does not constitute a recommendation, endorsement, or approval of the substance for any particular use.

7. Shipping

We accept inbound samples from addresses within Canada only. We do not currently accept international samples. Any return shipment of remaining sample material is provided at our discretion and may incur additional fees.

8. Cancellation and Refunds

Orders may be cancelled and refunded in full prior to receipt of your sample at our laboratory. Once your sample has been received and analysis has commenced, the order is non-refundable. If we are unable to perform the requested analysis due to insufficient sample, sample degradation, or operational issues on our part, we will, at our option, either re-run the analysis or issue a refund of the affected portion of the order.

9. Confidentiality

We treat all order details, sample information, and Customer identities as confidential, and we will not disclose them to any third party except (a) to our service providers as necessary to perform the Services, (b) as required by law, court order, or regulatory authority, or (c) with your express consent. 10. Intellectual Property

All content on the Website, including text, graphics, logos, images, and the "Peptide Test Canada" name and brand, is the property of Peptide Test Canada or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent. Certificates of Analysis are provided to you for your own internal use; you may share an unmodified, complete copy with third parties for legitimate research or transactional purposes.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and the Website are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that test results will meet any particular standard beyond the analytical methods described in the corresponding Certificate of Analysis.

12. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Peptide Test Canada, its officers, employees, contractors, or agents be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Website or the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or related to these Terms or the Services will not exceed the amount you paid to us for the specific Services giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited or excluded under the laws of Ontario, including the Consumer Protection Act, 2002 (Ontario) where applicable.

13. Indemnification

You agree to indemnify, defend, and hold harmless Peptide Test Canada and its officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms, (b) your submission of any sample to us, (c) your use of the Services or test results, or (d) your violation of any law or the rights of any third party.

14. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from causes beyond our reasonable control, including acts of God, natural disasters, government actions, labour disputes, supply chain disruptions, pandemics, or failures of utilities, telecommunications, or third-party service providers.

15. Privacy

Your use of the Website and the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

16. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and we irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario sitting in the City of Toronto for the resolution of any dispute, except where applicable consumer protection law grants you the right to bring proceedings in your province of residence.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Material changes will be posted on the Website. Your continued use of the Website or Services after such posting constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation we issue to you, constitute the entire agreement between you and us with respect to the Services and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

20. Language
